End User License Agreement

This End User License Agreement (“Agreement”) is a legal agreement between you (“You” or “User”) and Scout Ashes LLC, the owner of the Scout Ashes mobile application (the “App”). By downloading, installing, or using the App, you agree to be bound by this Agreement.

1. License grant

Subject to your compliance with this Agreement, Scout Ashes LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes on a compatible device.

2. Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Modify, adapt, translate, or create derivative works of the App.
• Rent, lease, loan, sell, sublicense, distribute, or otherwise transfer the App.
• Use the App for any unlawful, harmful, or abusive purpose.

3. Intellectual property

The App and all associated intellectual property rights are the exclusive property of Scout Ashes LLC or its licensors. This Agreement does not grant you any rights to the trademarks or service marks of Scout Ashes LLC.

4. User content

If the App allows you to submit or upload content:

• You retain ownership of your content.
• You grant Scout Ashes LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with operating the App.

5. No warranty

The App is provided “as is” and “as available” without warranty of any kind. To the maximum extent permitted by applicable law, Scout Ashes LLC disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Scout Ashes LLC does not warrant that the App will meet your requirements, that it will be uninterrupted, timely, secure, or error-free, or that any information provided by the App is accurate or reliable.

6. Limitation of liability

To the maximum extent permitted by applicable law, Scout Ashes LLC shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, data, or goodwill, arising out of the use of or inability to use the App.

In no event shall Scout Ashes LLC’s total liability to you exceed the amount paid by you, if any, for accessing or using the App.

7. Indemnity

You agree to indemnify and hold harmless Scout Ashes LLC, its directors, officers, employees, and agents from any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys’ fees) arising from your use of or access to the App, your violation of this Agreement or any applicable law, or your violation of any third party’s rights, including intellectual property or privacy rights.

8. Termination

This Agreement is effective until terminated. Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies.

9. Export control

You may not use, export, or re-export the App except as authorized by applicable U.S. law and the laws of the jurisdiction in which the App was obtained.

10. Governing law & disputes

United States & Canada

This Agreement is governed by the laws of the State in which Scout Ashes LLC is organized, without regard to its conflict-of-law principles, and you agree to submit to the exclusive jurisdiction of the courts located there.

Australia

This Agreement is governed by the laws of New South Wales, and any disputes will be resolved in the courts of New South Wales.

Germany

This Agreement is governed by the laws of the Federal Republic of Germany. Mandatory consumer protections under the German Civil Code (BGB) remain unaffected.

11. Severability

If any provision of this Agreement is held to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Entire agreement

This Agreement constitutes the entire agreement between you and Scout Ashes LLC concerning the App and supersedes all prior agreements.
